Did you know that the average pay gap between men and women in Estonia is 13.1%? This means that women earn less than men for doing the same job. Trade unions are therefore stressing the need to raise awareness, as this is the only way to ensure equal treatment for all workers, regardless of gender.
Estonian Trade Union Confederation lawyer Nelli Loomets explains: "If a worker feels gender inferior in the workplace, he or she does not need to prove unfair treatment. It is enough to present facts indicating such treatment. The onus is then on the employer to prove that there was no discrimination. However, if the employer refuses to provide evidence, it is deemed to have accepted discrimination."
Loomets adds that victims of gender discrimination have the right to claim not only an end to unfair treatment, but also compensation for damages, including moral damages.
