See on t\u00f6\u00f6tajatele hea v\u00f5imalus leppida \u00fchiselt kokku t\u00f6\u00f6tasus, t\u00f6\u00f6ajas ja muudes t\u00f6\u00f6tingimustes. \u00dcheskoos on oma huvide eest t\u00f5husam seista.<\/p><p><strong><br \/>\u0417\u0430\u043a\u043b\u044e\u0447\u0435\u043d\u0438\u0435 \u043a\u043e\u043b\u043b\u0435\u043a\u0442\u0438\u0432\u043d\u043e\u0433\u043e \u0434\u043e\u0433\u043e\u0432\u043e\u0440\u0430<br \/><\/strong>Kollektiivl\u00e4bir\u00e4\u00e4kimisi on \u00f5igus pidada ameti\u00fchingul. Kui t\u00f6\u00f6kohal ameti\u00fchingut ei ole, v\u00f5ib l\u00e4bir\u00e4\u00e4kimisi pidada ka t\u00f6\u00f6tajate usaldusisik. Kollektiivlepinguid saab s\u00f5lmida ettev\u00f5tte, sektori v\u00f5i riigi tasandil. N\u00e4iteks on sektorikokkulepped s\u00f5lmitud transpordi ning tervishoiu valdkondades.<\/p><p>Riiklikul tasandil kinnitatakse valitsuse m\u00e4\u00e4rusega igal aastal t\u00f6\u00f6tasu alamm\u00e4\u00e4r. Selle lepivad kollektiivlepinguga eelnevalt kokku Eesti T\u00f6\u00f6andjate Keskliit ja Eesti Ameti\u00fchingute Keskliit.<\/p><p>L\u00e4bir\u00e4\u00e4kimiste alustamiseks teeb huvitatud pool teisele poolele kirjaliku ettepaneku ning esitab ka kokkuleppe projekti. T\u00f6\u00f6andja peab alustama l\u00e4bir\u00e4\u00e4kimisi seitsme p\u00e4eva jooksul p\u00e4rast ettepaneku saamist. L\u00e4bir\u00e4\u00e4kimistel osalemiseks vabastatakse t\u00f6\u00f6tajate esindajad poolte kokkuleppel oma p\u00f5hit\u00f6\u00f6st ning neile s\u00e4ilitatakse selle aja eest keskmine t\u00f6\u00f6tasu.<\/p><p>Sektori ja riikliku tasandi kollektiivlepinguid v\u00f5ivad s\u00f5lmida ainult ameti\u00fchingud.<br \/><br \/><\/p><p><strong>Kollektiivlepingu ulatus<br \/><\/strong>Ettev\u00f5ttes s\u00f5lmitud kollektiivleping kehtib selle organisatsiooni ameti\u00fchinguliikmetele ning laieneb tavaliselt k\u00f5igile t\u00f6\u00f6tajatele, l\u00e4htudes t\u00f6\u00f6tajate v\u00f5rdse kohtlemise n\u00f5udest. Enamasti lepitakse lepinguga kokku t\u00f6\u00f6- ja puhkeaja pikkus, t\u00f6\u00f6tasu suurus jne.\u00a0<\/p><p>Sektorip\u00f5hine kollektiivleping laieneb k\u00f5igile vastava tegevusala t\u00f6\u00f6tajatele, olenemata nii t\u00f6\u00f6tajate kuulumisest ameti\u00fchingusse kui t\u00f6\u00f6andjate kuulumisest t\u00f6\u00f6andjate liitu.\u00a0<br \/><br \/><\/p><p><strong>\u0412\u0441\u0442\u0443\u043f\u043b\u0435\u043d\u0438\u0435 \u0432 \u0441\u0438\u043b\u0443, \u0434\u0435\u0439\u0441\u0442\u0432\u0438\u0435 \u0438 \u043f\u0440\u0435\u043a\u0440\u0430\u0449\u0435\u043d\u0438\u0435 \u0434\u0435\u0439\u0441\u0442\u0432\u0438\u044f \u043a\u043e\u043b\u043b\u0435\u043a\u0442\u0438\u0432\u043d\u043e\u0433\u043e \u0434\u043e\u0433\u043e\u0432\u043e\u0440\u0430<br \/><\/strong>Kollektiivleping j\u00f5ustub selle allakirjutamise p\u00e4eval v\u00f5i poolte poolt kokkulepitud kuup\u00e4eval. Vajadusel v\u00f5ivad lepingu eri tingimused j\u00f5ustuda erineval ajal, n\u00e4iteks v\u00f5ib palk t\u00f5usta tagasiulatuvalt.<\/p><p>Tavaliselt s\u00f5lmitakse kollektiivleping \u00fcheks aastaks ning sama kehtib ka siis, kui pooled pole lepingu kehtivusaega eraldi kokku leppinud. Liiga pikk kehtivusaeg ei pruugi olla m\u00f5istlik, sest osa tingimusi - n\u00e4iteks t\u00f6\u00f6tasu puudutavad kokkulepped, vajavad regulaarset \u00fclevaatamist. Samas v\u00f5ivad pooled soovi korral kokku leppida ka pikemas kehtivusajas.<\/p><p>Kollektiivleping l\u00f5ppeb uue, samasisulise lepingu s\u00f5lmimisega. Kui lepingu t\u00e4htaja m\u00f6\u00f6dumisel uut kokkulepet ei s\u00f5lmita, peavad pooled j\u00e4tkama senise kollektiivlepingu tingimuste t\u00e4itmist. Kui t\u00f6\u00f6kohal ameti\u00fchingut ei ole, teeb seda t\u00f6\u00f6tajate usaldusisik.<\/p><p>T\u00f6\u00f6andjal on kohustus tutvustada kehtivat kollektiivlepingut k\u00f5igile uutele t\u00f6\u00f6tajatele. Uue kollektiivlepingu s\u00f5lmimisel tuleb selle sisust teavitada k\u00f5iki t\u00f6\u00f6tajaid. Kollektiivlepingu tekst peab olema t\u00f6\u00f6tajatele alati k\u00e4ttesaadav, et iga\u00fcks saaks oma \u00f5iguste ja kokkulepitud t\u00f6\u00f6tingimustega tutvuda.<\/p><p>Eri ameti\u00fchingute ja nende liitude s\u00f5lmitud kollektiivlepinguid leiab tavaliselt nende veebilehtedelt.
